1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) constitute a legal agreement between you (“you,” “your,” or “Client”) and Maple Lotus Yoga Inc. (“Maple Lotus Yoga Inc.,” “we,” “us,” or “our”), governing your access to and use of our yoga, meditation, breathwork, wellness, and related services, whether delivered in person, online, or through any other medium.
By booking, attending, purchasing, registering for, or otherwise using any service provided by Maple Lotus Yoga Inc., you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
These Terms should be read together with any waivers, intake forms, booking policies, studio rules, and privacy notices provided by us from time to time. If there is a conflict between these Terms and any service-specific waiver or policy, the more specific document will prevail to the extent of the inconsistency.
2. Scope of Services
Maple Lotus Yoga Inc. provides wellness and movement-based services that may include, without limitation:
- Beginner Hatha Yoga Classes
- Vinyasa Flow Sessions
- Restorative Yoga and Relaxation
- Prenatal Yoga Classes
- Private One-on-One Yoga Coaching
- Corporate Wellness Yoga Programs
- Meditation and Breathwork Workshops
Our services may be offered as drop-in classes, packages, memberships, private sessions, workshops, retreats, or corporate programming. We reserve the right to modify class formats, instructors, schedules, locations, duration, capacity, and pricing at any time, subject to applicable law and any advance notice we consider reasonable.
Our services are intended for general wellness, fitness, relaxation, and educational purposes only. They are not a substitute for medical advice, diagnosis, treatment, physiotherapy, psychotherapy, or any other licensed healthcare service.
3. User Obligations and Responsibilities
By using our services, you agree to the following responsibilities:
- You are at least the age of majority in your province or territory of residence, or you have parental/guardian consent if a minor is permitted to participate.
- You will provide accurate, current, and complete information when registering, booking, or completing intake forms.
- You will inform us promptly of any medical condition, injury, pregnancy-related concern, physical limitation, or other circumstance that may affect your safe participation.
- You will consult a physician or other qualified healthcare professional before participating if you have any doubt regarding your ability to engage safely in physical activity, breathwork, or meditation.
- You will follow all instructions, safety guidance, studio rules, and reasonable directions given by instructors or staff.
- You will not participate while under the influence of alcohol, cannabis, illegal drugs, or any substance that may impair safe participation.
- You will use equipment properly and notify us immediately of any damage, defect, or safety concern.
- You will treat instructors, staff, and other participants with respect and will not engage in harassment, discrimination, abusive conduct, or disruptive behavior.
You understand and acknowledge that yoga, stretching, breathwork, meditation, and related physical activities involve inherent risks, including but not limited to slips, falls, strains, sprains, dizziness, dehydration, overexertion, and other injuries. You assume full responsibility for deciding whether to participate and for modifying or discontinuing any movement or practice as needed.
If you are participating in Prenatal Yoga Classes, you acknowledge that pregnancy carries special considerations and that you are solely responsible for obtaining medical clearance where appropriate and for advising us of any changes to your condition. Participation may be refused or modified if safety concerns arise.
4. Payment Terms and Conditions
All fees, taxes, and applicable charges will be disclosed at the time of purchase, booking, or registration unless otherwise stated. Prices are subject to change at any time. Where required by law, applicable GST/HST/PST will be added to the purchase price.
Payment must be made using an approved payment method. You authorize Maple Lotus Yoga Inc. and our payment processors to charge the payment method provided for all amounts due, including recurring fees if you enroll in a membership or subscription plan.
Unless otherwise stated in writing:
- All payments are due in advance of the service or at the time of booking.
- Packages, class passes, workshops, private sessions, and memberships are non-transferable unless expressly permitted by us.
- Late payments may result in cancellation of bookings, suspension of access, or collection action where applicable.
- You are responsible for any fees charged by your bank, credit card issuer, or payment provider.
If a charge is reversed, disputed, or returned due to insufficient funds or other payment failure, we may suspend access to services until the balance is resolved.
5. Cancellation and Refund Policy
Our cancellation and refund policy applies subject to any service-specific terms communicated at the time of booking.
- Classes and Drop-In Sessions: Cancellations made within the required cancellation window, if any, may be rescheduled or credited at our discretion. Late cancellations and no-shows may be charged in full.
- Private One-on-One Yoga Coaching: You must provide notice of cancellation or rescheduling within the timeframe communicated at booking. Failure to do so may result in forfeiture of the session fee.
- Workshops, Courses, and Special Events: These may be non-refundable, except where cancellation is required by law or explicitly stated otherwise.
- Memberships and Packages: Unused visits, credits, or sessions may expire in accordance with the published validity period. No cash refunds are provided for unused portions unless required by applicable law or expressly approved by us in writing.
If Maple Lotus Yoga Inc. cancels a class, session, or event, we may, at our discretion, offer a refund, credit, substitute service, or rescheduling option. We are not responsible for travel, childcare, parking, or other incidental expenses incurred by you.
Refunds, where approved, will be processed using the original method of payment when reasonably possible. Processing times may vary depending on the financial institution.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Lotus Yoga Inc., including its directors, officers, employees, contractors, instructors, agents, affiliates, and representatives, will not be liable for any direct or indirect loss, damage, injury, illness, death, delay, loss of enjoyment, or expense arising out of or in connection with your use of our services, except to the extent caused by our gross negligence or wilful misconduct where such limitation is not permitted by law.
You acknowledge and agree that:
- You participate voluntarily and at your own risk.
- You are responsible for using your own judgment in modifying poses, practices, and intensity.
- We do not guarantee any specific health, fitness, emotional, therapeutic, or spiritual outcome.
- We are not responsible for any loss or damage to your personal property unless required by applicable law.
Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable Canadian law, including liability for fraud, wilful injury, or any mandatory consumer protections that apply.
7. Intellectual Property Rights
All content provided by Maple Lotus Yoga Inc., including but not limited to class sequences, teaching methods, workshop materials, text, graphics, logos, videos, audio recordings, handouts, photographs, course outlines, and website content, is owned by or licensed to Maple Lotus Yoga Inc. and is protected by Canadian and international intellectual property laws.
You may not, without our prior written consent:
- copy, reproduce, distribute, modify, sell, sublicense, or publicly display our content;
- record classes or workshops, whether by audio, video, or screen capture, unless expressly permitted;
- use our materials for commercial purposes or to create competing services;
- remove proprietary notices or attempt to reverse engineer any digital content or systems we provide.
You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and use materials provided solely for your own non-commercial personal wellness use, subject to these Terms.
8. Data Protection and Privacy
Maple Lotus Yoga Inc. collects, uses, and discloses personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation where relevant.
We may collect personal information such as your name, contact details, emergency contact information, health-related information you voluntarily provide, booking history, payment information, and attendance records for purposes including:
- administering bookings and providing services;
- processing payments and managing accounts;
- communicating updates, schedules, and service information;
- supporting safety, risk management, and emergency response;
- complying with legal, accounting, and regulatory obligations; and
- improving our services and operations.
We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Where necessary, we may use third-party service providers, such as booking platforms, email services, payment processors, and analytics providers, who may process data on our behalf under contractual or legal safeguards. By using our services, you consent to such processing to the extent permitted by law.
You may contact us to request access to, or correction of, your personal information, subject to legal limits and identity verification requirements.
9. Force Majeure
Maple Lotus Yoga Inc. will not be liable for any delay, interruption, cancellation, or failure to perform any obligation under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, fire, flood, pandemic, epidemic, public health orders, power outages, labour disputes, strikes, government actions, transportation disruptions, venue unavailability, internet failures, cyber incidents, or acts of God.
In the event of force majeure, we may, at our discretion, reschedule, modify, substitute, suspend, or cancel services without liability except as required by applicable law.
10. Changes to Terms
We may update, revise, or replace these Terms from time to time to reflect changes in our services, legal requirements, operational needs, or for other legitimate business reasons. The updated Terms will be effective upon posting or on any later effective date specified by us.
It is your responsibility to review these Terms periodically. Your continued use of our services after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.
11. Applicable Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that any dispute, claim, or proceeding arising out of or relating to these Terms or our services will be brought exclusively in the courts located in British Columbia, Canada, unless applicable law requires otherwise. Nothing in this section limits any consumer rights or statutory protections that cannot be waived under applicable law.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or other competent authority, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect to the fullest extent permitted by law.
Any failure by Maple Lotus Yoga Inc. to enforce any right or provision under these Terms will not constitute a waiver of such right or provision unless expressly acknowledged in writing.
